Underage Gambling Litigation Lawyer
Unexpected online gambling charges or gambling-style activity involving a young person can leave you trying to protect family finances and understand which accounts were used. You may be unsure how the service handled age checks, payment authorization or requests to restrict activity.
At Rafferty Domnick Cunningham & Yaffa, we review the platform, the user’s age and location, payment records and communications with the company. We can explain which questions require investigation and whether the particular facts and applicable law support a claim.
Potential concerns include advertising directed at young users, age verification, payment controls and how a platform responds to reports of unauthorized activity. Allegations about a company must be assessed against its actual practices and the law governing the particular product. Naming a platform does not establish that it violated the law.
If gambling-style online activity has caused financial or other harm to a young person in your family, we can review the platform, the activity, the person’s age and location, and the records of what occurred. Eligibility depends on the applicable law and facts, not a single age cutoff used for every service.
What Should Families Examine About Online Gambling Platforms?
The first task is to identify the activity: regulated wagering, a casino-style product, an in-game purchase or another paid feature. These activities do not all have the same legal status. Age requirements, authorization and available remedies depend on the product and jurisdiction.
A review may examine age controls, payment authorization, advertising, disclosures and the response to requests for help or account restrictions. The FTC’s consumer guidance discusses unexpected game purchases and advertising; that does not make every game purchase gambling or create an automatic private injury claim.

How Young People Are Harmed by Online Gambling
The consequences of underage gambling are severe and far-reaching. Victims often experience:
- Financial losses — Transaction records can document disputed spending and its effect on the family. A loss alone does not establish a right to repayment.
- Compulsive activity – Record patterns such as repeated spending, difficulty stopping or efforts to conceal activity, without attempting to diagnose the young person yourself.
- Health concerns – A qualified clinician can evaluate changes in mood, anxiety or other symptoms and recommend appropriate support. A legal claim requires separate evidence of the relationship between the conduct and the alleged harm.
- Disruption to daily life – Keep accurate records of any effects on school, work and family activities.
- Family Breakdown – Parents and siblings frequently endure emotional and financial fallout alongside the child.
Financial loss or distress alone does not establish platform liability. The review must connect specific conduct to an applicable duty, a legally supported claim and the harm alleged.
What Information Helps Evaluate a Potential Claim?
A potential claim requires more than proof that money was lost. We need to understand the specific conduct challenged, the law that may apply and the harm connected to it. Record the young person’s age when the account was created and used, their location, the platform and the relevant dates.
Bank statements, transaction histories, advertisements, account settings and communications about restrictions or refunds can help establish what occurred. If there are health concerns, qualified treatment and accurate medical records are important independently of any legal claim.

What Conduct May Need Investigation?
We examine whether the evidence shows misrepresented costs or odds, unauthorized purchases, disregard of applicable age restrictions or failure to honor account limits. We assess those concerns against the service’s actual conduct and the law that applies; naming a company alone does not establish wrongdoing.
Consumer-protection complaints, contract disputes and personal-injury claims have different requirements and remedies. We identify the proposed claim and evidence before advising that litigation is appropriate.

What Remedies May Be Available?
The available remedy depends on the claim. A disputed purchase or refund request is different from a supported claim for treatment costs or other injuries. The transaction history, evidence of responsibility and applicable law determine what can be sought.
We do not promise repayment of all losses or punitive damages. A careful evaluation also considers platform terms, dispute procedures and deadlines, so a family can understand the practical choices.

Florida Underage Gambling and Online Purchase FAQs
These answers provide general information. The facts, dates and law governing an individual claim require a separate review.
Is every in-game purchase legally treated as gambling?
No. Regulated wagering, casino-style products, randomized purchases and ordinary game transactions can raise different legal questions. The actual activity, location, payment method and governing rules must be identified. A product’s appearance or the fact that money was lost does not alone establish illegal gambling.
Preserve the platform name, terms, transaction history and representations about costs or odds. FTC guidance discusses unexpected game purchases and advertising, while Florida’s gaming statutes address defined activities under their own framework. Counsel should identify the specific claim and law before characterizing the conduct. A consumer purchase dispute and a personal-injury action are not automatically the same case.

Is there one minimum age that applies to every online gambling-related claim?
Bring the account creation and transaction dates, location and platform information. Florida’s gaming compact statute addresses defined activities, while privacy rules can use different age thresholds for different purposes. Those provisions should not be merged into one universal eligibility test. A careful review applies the correct rule to the actual product and facts.

Can every gambling or game-purchase loss be recovered through a lawsuit?
No. A financial loss does not automatically establish a right to repayment or damages. The claim must identify a legal basis, responsible party and supported connection between the conduct and loss. Platform terms, authorization, applicable law and dispute procedures may all matter.
Keep the complete transaction history and distinguish authorized spending, disputed charges and any alleged deceptive representation. FTC consumer guidance can help explain practical purchase controls, but it does not create an automatic individual payout. Counsel should assess whether the facts support a refund process, contract or consumer claim, or another remedy rather than promise recovery of every dollar spent.

What evidence matters if a young person used an adult’s payment account?
The review needs the transaction and authorization history, not just the total charged. Preserve statements, account settings, receipts, communications and any dispute or refund requests. Who authorized what, how the charges occurred and what the platform represented can affect the available options.
Describe the circumstances accurately, including any permission that was given. FTC guidance discusses ways to manage unexpected game purchases, while a legal claim requires the applicable theory and evidence. Do not change account records or label every charge unauthorized without a factual basis. A complete chronology helps distinguish a family spending problem from a supported claim against a platform or another party.

Does a gambling-related health problem prove a platform is liable?
Preserve the account history and relevant treatment information, including other circumstances clinicians consider important. Health records may generally be requested from covered providers under applicable rules. A legal review should explain what additional evidence is needed and avoid treating every loss or distress as the same injury. Care should be pursued for the person’s needs, not to create a litigation record.

Should I delete transaction records after closing or restricting an account?
Preserve relevant records safely when a dispute or legal claim is being considered. Restricting access for safety or spending control is different from destroying the history needed to understand what happened. FTC guidance describes practical controls, while litigation rules can affect preservation and production of evidence.
Keep statements, receipts, ordinary communications and the terms or settings available to you. Do not continue spending merely to gather more evidence, and do not alter the historical record. Counsel can explain what should be retained and how to handle sensitive information. A complete record helps assess authorization, representations and losses without assuming that closing the account resolves the dispute.

Does a child’s age automatically extend the deadline for an online gambling claim?
No universal rule allows every claim involving a child to wait until adulthood. The applicable state law, legal theory, dates and statutory tolling provisions must be reviewed. A claim involving abuse, a platform feature, a contract or another theory may present different timing questions.
For a Florida-connected claim, counsel should examine the limitation and tolling statutes alongside the actual facts. Bring the ages and dates of platform use, alleged harm, discovery and any prior report or filing. Reporting to a company or agency does not automatically file a civil action. Prompt review can identify the correct deadline without assuming that minority alone protects every possible claim.

What records can help document harm in an online gambling claim?
Relevant records should show what occurred, when it occurred and the injury or loss alleged. Depending on the claim, these may include account information, ordinary communications, transaction histories, treatment records and school or work changes. Records should be preserved accurately and handled with attention to the child’s privacy.
Medical and billing records may generally be requested from covered providers, subject to applicable access rules and exceptions. Litigation also has procedures for obtaining relevant information and protecting appropriate confidential material. A chronological collection is more useful than selected excerpts that omit context. Counsel should identify the necessary evidence and lawful handling method rather than ask the family to investigate unsafe or unlawful content.
Sources: HHS: health information individuals may access; Federal Rules of Civil Procedure, effective December 1, 2025.
Does an online gambling claim require proof beyond platform use?
Yes. Platform use alone does not establish a legally viable injury claim. The evidence must support the conduct challenged, the applicable legal theory, a recognized harm and the required connection between them. The existence of other lawsuits does not supply those facts for an individual family.
A useful review separates observations from conclusions: what features were used, what communications or transactions occurred, what changed and what qualified professionals documented. Other circumstances may also matter. The family should receive a clear explanation of the evidence needed and legal uncertainties. Litigation procedures allow claims to be tested; filing a complaint does not establish that its allegations are true.
Sources: Federal Rules of Civil Procedure, effective December 1, 2025; Florida civil jury instructions, negligence and compensatory damages.
How would a settlement for a child’s online gambling claim be handled?
A child’s settlement requires attention to the applicable minor-protection rules and the authority of the representative. Where Florida’s framework applies, court approval and other safeguards may be required depending on the circumstances. A parent should not assume that an ordinary release is sufficient or that all proceeds can be used freely.
The review should address the child’s interests, the claims released, fees, expenses and how funds will be held or managed. If an adult also has a claim, potential conflicts and allocations need attention. A proposed amount should be evaluated against the evidence and terms, not accepted solely because another family received a publicized result.
