PALM BEACH GARDENS, Fla. (October 3, 2018) – Fred Cunningham, a Shareholder at Rafferty Domnick Cunningham & Yaffa, lectured at the Broward County Trial Lawyers Association (BCTLA) monthly meeting on October 2, 2018. His topic “Insurance Bad Faith Law Update: What You Need to Know,” came on the heels of Suzanne Harvey, etc. v. Geico General Insurance Company, a landmark decision with respect to Florida insurance bad faith law which was issued by the Florida Supreme Court on September 20, 2018.
In its 4-3 ruling, the Court determined that the Fourth District Court of Appeal misapplied the Florida Supreme Court’s bad faith precedent and relied on inapplicable federal caselaw when it reversed a jury verdict which found Geico had acted in bad faith in failing to settle a claim brought against its insured. Mr. Cunningham brought the bad faith action against Geico on Harvey’s behalf. Mr. Cunningham is a frequent lecturer on insurance bad faith litigation with a national trial reputation for resolving complex cases. His record of success is evidenced by nearly $500 million in settlements and verdicts.
The Broward County Trial Lawyers Association was founded in 1963 to serve members of the legal profession who focus on civil litigation and to work with the Judiciary of Broward County, Florida on a wide range of matters impacting the legal community. BCTLA consists of attorneys, judges and affiliated legal professionals from the tri-county area.
