Peters v. LabCorp
Lawsuit Alleges Cervical Cancer Death Caused by Misread Pap smear
A cervical cancer misdiagnosis case filed in Federal Court alleges that national laboratory giant LabCorp failed to detect and report the presence of cervical cancer cells on the Pap smear slide of Plaintiff Amanda J. Peters, resulting in her tragic death on August 21, 2014.
Mrs. Peters, wife to John Peters, and mother of three young children, Nathan, Chloe and John III, had a lab test performed to detect cervical cancer on July 9, 2008. The test was then sent to LabCorp to properly examine, interpret, and accurately report the results. Tragically, per the lawsuit, LabCorp misread the Pap smear test results as “negative for intraepithelial lesion and malignancy” instead of accurately diagnosing the presence of cancerous cells which would have led to life-saving treatment.
Cervical cancer is one of the most preventable forms of cancer with proper diagnosis and preventative care. Unfortunately, while Mrs. Peters followed the proper procedures to ensure her health and wellbeing, the lawsuit alleges that Defendant LabCorp failed to do the same. The lawsuit further charges that LabCorp was negligent and failed to exercise reasonable care, measures that would have saved Mrs. Peters life.
Plaintiff attorneys Sean C. Domnick of Rafferty Domnick Cunningham & Yaffa and Gary Osborne are representing the Peters family in this medical malpractice lawsuit. The wrongful death case, currently pending in Federal Court of the Southern District of Ohio, is set for trial in June 2018.
